What a crock. It should go to a higher court yet again. The appelatte court ruled for the prosecution due to the "extensive experience with horses by animal control officers". Huh? Did the appelatte judges even read the transcripts? So I will ask again... who is held responsible for the scrawny, skinny, wormy, sickly horses with horrendous feet that were brought into the auctions 6 months later by animal control?

And I just saw an ad on craigslist last night (would have to look for it again) the person had several horses for $200 each and said that two of the mares were from the "jackson county deal" so she didn't have the papers on them. so sad to see horses having to be sold by anyone in this market but then to know these are some from that case... mta: found the ad.. grandrapids.craigslist.org/grd/1019080568.html

I'm hopeful that those "rescued" horses aren't malnourished already. People are losing jobs all the time and hay is expensive.
Just added over at Midwest Horse:
Been reading the Court of Appeals' written judgment.
This sets some dangerous precedents:
YOU can be charged with felony torture if your horse is at a boarding stable, training barn, breeding farm and something happens -- without your consent or knowledge -- that the court finds "mutilates, maims or disfigures" your animal.
Some examples of dangerous and unsanitary living conditions:
* HOSE in the field -- last time I checked, there is a dangerous hose in my field every time we fill the tank * a few INCHES of manure in a stall -- yes, inches is specified -- that's one steaming pile of dung, folks * dirty water, natural water source that may be contaminated by others * what some consider "poor" quality hay -- sorry, but "good" hay would kill my easy keeper

Just joined here... Don't count us out yet. It's unfortunate that even the Court of Appeals who is supposed to be impartial, pulled some new lies and misinformation out.
The precedent set is a dangerous one as XP stated. The definition of torture is NOW that the animal felt pain and you disregarded known risks. Every day is a known risk with horses, regardless of how much you try to keep them healthy.
Bottom line is if you don't call a vet for every injury or illness, you can be prosecuted for Felony Animal Torture.
Michigan Supreme Court is the next step.
